1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and BicepHeartAI ("we", "us", or "our", accessible at https://bicepheartai.pro). By accessing our website, creating an account, purchasing video credit packages, or generating videos, you expressly agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all terms and conditions herein, you must immediately cease accessing or using our services.

2. Platform Description & AI Video Generation

BicepHeartAI provides a specialized artificial intelligence video generation service that animates a single photo of a person or pet into a 7-second 9:16 vertical silent MP4 video featuring a bicep curl flex culminating in a heart-shaped muscle peak.

• Direct Generation — There is no static AI preview stage. Uploading a photo provides local preview feedback in your browser; submitting a generation request consumes 1 video credit and queues cloud video rendering.
• Model Disclosure — Current video generation uses Seedance 2.0 Mini (ByteDance).
• Probabilistic AI Outputs — Generative video models produce outputs probabilistically based on your uploaded source photo, framing, and selected mode. While we optimize prompt adherence and motion quality, we do not warrant that generated media will conform to subjective artistic preferences or produce anatomical precision under poor input lighting or framing.
• Format & Deliverables — All generated videos are delivered as 7-second vertical (9:16 aspect ratio) silent MP4 files at either 480p or 720p resolution without watermarks.

3. User Accounts & Security

• Eligibility — You must be at least 18 years of age or the age of majority in your jurisdiction to create an account and purchase paid credits.
• Account Safeguarding — You are responsible for safeguarding your login credentials and for all video generation activities conducted under your account.
• Fair Usage — Exploiting introductory offers or creating multiple automated accounts to evade purchasing credits is strictly prohibited.

4. Video Credit Packs & Billing

• One-Time Packages — Access to video generation is metered via one-time credit packages (Single 1 video, Trio 3 videos, Creator 7 videos). We do not charge recurring subscriptions.
• No Expiration — Unused video credits purchased on your account do not expire.
• Credit Consumption & Automatic Restore — One credit is deducted when you confirm a video generation request. In the event of an unrecoverable system or provider failure before video completion, the deducted credit count is automatically restored to your account balance.
• Payment Processing — Payments are securely handled by authorized third-party billing providers. We do not store complete payment card credentials on our servers.

5. Ownership & Commercial Usage Rights

• Your Source Photos — You retain full ownership, title, and responsibility for any photos you upload. You represent and warrant that you own or have obtained all necessary permissions, rights, and releases from individuals depicted in uploaded photos.
• Generated Videos — Subject to your compliance with these Terms, you receive full commercial and personal usage rights to the MP4 video deliverables generated through your paid credits, including sharing on social media platforms, embedding in creative projects, or monetization.
• Platform IP — All platform code, user interfaces, branding, visual assets, trademarks, and documentation remain our exclusive property.

6. Acceptable Use Policy (AUP)

You agree to use BicepHeartAI strictly in compliance with applicable law and ethical norms. You are categorically prohibited from uploading photos or attempting to generate content that involves:

1. Child Sexual Abuse Material (CSAM) — Absolute zero tolerance. Any upload or attempt involving minor exploitation, abuse, or CSAM will result in immediate permanent account termination and referral to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
2. Non-Consensual Imagery & Defamation — Uploading photos of individuals without their explicit knowledge and consent, or using generated videos to harass, demean, or defame any person.
3. Pornography & Explicit Sexual Content — Uploading sexually explicit, nude, or pornographic material.
4. Violence, Hate Speech & Harassment — Content depicting severe gore, animal abuse, hate speech, or incitement to violence.
5. Infringement of Third-Party Rights — Uploading images that violate third-party copyrights, trademarks, or publicity rights.

7. Content Moderation & Enforcement

We employ automated safety filtering and moderation protocols:

• Uploaded photos and generation requests that violate safety standards will be rejected.
• Repeated or intentional violations will lead to immediate account suspension or termination and forfeiture of remaining credits.
• To report violations or rights infringements, please submit a report through our customer support tickets.

8. Disclaimer of Warranties

The platform and AI generation services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted uptime.

9. Limitation of Liability

In no event shall BicepHeartAI, its operators, or service partners be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the service, even if advised of the possibility of such damages.

10. Modifications to Terms

We may update these Terms periodically to reflect platform enhancements or regulatory changes. The latest revision date appears at the top of this document. Continued use of BicepHeartAI following updates constitutes acceptance of the modified Terms.
